
If your NSW property has a swimming pool or spa pool, you cannot sell or lease it without the right pool safety paperwork attached to the contract. This has been the law since 29 April 2016, and getting it wrong can let a buyer walk away from the sale. Here is what actually applies, in plain terms, and how to avoid a settlement delay.
To sell a property in NSW with a pool or spa, you must attach one of the following to the contract for sale:
To lease a property with a pool, you need either a valid certificate of compliance or a relevant occupation certificate. A certificate of non-compliance is not enough to lease.
Your pool must also be listed on the NSW Swimming Pool Register before a certificate can be issued.
If a valid certificate is not attached to the contract for sale, the purchaser can rescind the contract within 14 days of exchange, unless settlement has already happened. In practice that means a missing or expired certificate can collapse a sale or force a last-minute scramble. Agents cannot advertise a pool property for sale or lease without the paperwork in place, so this is not something to leave until the week before auction.
Here is the part that catches people out. Industry and council experience suggests a large share of pools fail their first inspection, often for small, fixable faults like a worn gate spring or a pot plant sitting inside the non-climbable zone. Rectification can take weeks, particularly if you need a contractor for barrier work, and a reinspection has to be booked after that.
If you are planning to sell in the next few months, book your inspection early. Trying to compress inspection, repairs and reinspection into a two-week pre-auction window is how sellers end up attaching a certificate of non-compliance and handing the problem to the buyer, which weakens your negotiating position.
A certificate of non-compliance lets you sell without first fixing the pool. You attach it to the contract, and the buyer takes on the obligation to make the barrier compliant within 90 days of settlement. It is a legitimate tool, but it is not a free pass:

A NSW certificate of compliance is valid for three years, unless a later inspection or a council direction changes that. So a certificate you obtained for a previous sale or lease may still be current. Check the NSW Swimming Pool Register before paying for a fresh inspection.
Owners in larger strata schemes are often exempt from the individual sale and lease certificate requirement. The requirement generally bites on schemes of two lots or fewer, where the pool is on the property being sold. If you are in a strata scheme, confirm your obligations before assuming you need your own certificate.
Do I need a pool certificate if I am not selling or leasing? The sale and lease rule is what triggers the certificate requirement, but your barrier must comply with the Swimming Pools Act at all times regardless. Council can inspect and direct works even if you never sell.
Can I sell with a non-compliant pool? Yes, by attaching a certificate of non-compliance and passing the rectification obligation to the buyer, who then has 90 days from settlement to fix it. You cannot lease on that basis.
How long does the certificate last? Three years from issue for a certificate of compliance, unless a later inspection or council direction says otherwise.
